The war over daily fantasy sports could end up being one of the bloodiest and most expensive wars ever fought over semantics. That's what this is really about, isn't it? It's about the difference between "games of skill" and "games of chance" as if, at the end of the day, there's a meaningful difference between the two. They're both games that most players lose money on. The major AMERICAN sports leagues, all of whom have benefited tremendously from the booming daily fantasy industry, say (a) they are opposed to sports gambling and (b) daily fantasy sports is not gambling. A state like NEVADA, which enjoys a federal-government-sanctioned monopoly on sports betting, says (a) of course daily fantasy is gambling and (b) watch your step before you start competing with the state's existing sports books. In CONGRESS, the case against FANDUEL and DRAFTKINGS is being driven by REP. FRANK PALLONE, whose home state, NEW JERSEY, has unsuccessfully fought pro sports leagues in court for the right to legalize sports betting, which means NEW JERSEY is basically on the record as both opposing and defending sports betting. FANDUEL and DRAFTKINGS walked away from NEVADA in a heartbeat when that state ordered them a month ago to seek gaming licenses. It's going to be harder to walk away from NEW YORK, whose attorney general declared war on the companies yesterday. FANDUEL is headquartered there, DRAFTKINGS has offices there, and both companies get more business from NEW YORK residents than from any other state. They seem prepared to fight.
